Article 3, Condition 9 (height restriction) of the Riviera Homeowners First Amendment To Declaration Of Establishment Of Restrictions (CC&Rs)

 

Condition 9 of the CC&Rs currently states:

‘9 – That no building or other structure erected on any of said lots shall exceed more than one (1) story or sixteen (16) feet in height above the highest point of the natural grade of the lot on the perimeter of this principal residential building, excepting that on Lots 29, 30, 31, 32, 42, 43, 44, 111, 112, 113, and 114 of said Tract No. 2964 any building may be not more than two (2) stories or 25 feet (25) feet in height above the highest point of the natural grade of the lot on the perimeter of the principal residential building.  Natural grade of the lot is hereby defined as being the grade of the lot as of the time of the first sale thereof by the subdividers.' 

 

Before City Planning will issue a building permit they will require a set of plans with the Riviera Committee On Architecture stamp affixed. In compliance with the Riviera District CC&Rs, please contact a member of our Committee On Architecture to review your plans for either remodeling or building in the Riviera. We are not concerned with architectural styles, exterior paint colors, or landscaping. We are primarily concerned with maintaining the 16-foot, or where allowed by lot number, the 25-foot building height restriction. Setback distances also concern us.
